Quote Validity & Client Responsibilities
Quotes are valid for thirty (30) days from the date issued. After that period, pricing is subject to change without notice. The client is responsible for obtaining all permits, approvals, authorizations, HOA approvals, and permissions required for work on the property. GroundWorx Lawn Care is not responsible for delays, fines, penalties, or additional costs resulting from missing approvals.
Scheduling & Delays
GroundWorx Lawn Care will make every reasonable effort to perform services on the scheduled date. Weather, equipment failure, traffic, material availability, emergencies, and other unforeseen circumstances may affect scheduling. Service dates are estimates and are not guaranteed.
Property Preparation
Clients must remove toys, hoses, pet waste, lawn furniture, decorations, extension cords, rocks, branches, and other personal property or obstacles from work areas before arrival. GroundWorx Lawn Care is not responsible for damage to items left within service areas.
Underground Utilities & Hidden Obstacles
GroundWorx Lawn Care is not liable for damage to unmarked or improperly marked irrigation systems, invisible fences, utility lines, drainage systems, septic components, cables, wiring, landscape lighting, or other concealed improvements. Clients must identify and clearly mark underground or hidden obstacles before work begins.
Plant Identification & Care
Clients must identify in writing any plants requiring special care or that should not be pruned, removed, treated, or disturbed before service begins. GroundWorx Lawn Care is not responsible for accidental damage to unmarked or unidentified plants.
Mowing & Trimming Risks
Mowing and string trimming can propel rocks, sticks, pine cones, mulch, acorns, gravel, and other debris. Clients are responsible for maintaining reasonably clear work areas. GroundWorx Lawn Care is not responsible for damage resulting from hidden debris that could not reasonably be seen before service.
Property Condition & Limitation of Liability
GroundWorx Lawn Care performs services using reasonable care and accepted industry practices. We are not responsible for pre-existing, deteriorated, weathered, brittle, loose, improperly installed, unsecured, rotted, rusted, cracked, previously repaired, or otherwise defective property. This includes siding, fencing, gates, edging, curbing, irrigation, drainage, masonry, pavers, retaining walls, mailboxes, decorative features, and outdoor lighting.
Windows, Vehicles & Breakable Objects
Clients should move vehicles, furniture, decorations, fragile items, and other breakable property away from work areas whenever practical. GroundWorx Lawn Care is not responsible for damage caused by concealed objects or naturally occurring debris that could not reasonably have been detected.
Weather & Acts of Nature
GroundWorx Lawn Care is not responsible for delays, property damage, plant damage, flooding, erosion, or other losses caused by weather, natural disasters, excessive rainfall, drought, freezing temperatures, hurricanes, or events beyond our control.
Plant Health & Warranty
Plant material is healthy and free of visible disease at installation. Because survival depends on watering, drainage, weather, insects, disease, animals, soil conditions, and maintenance beyond our control, no plant-survival warranty is provided unless stated in writing.
Payment Terms
Payment is due according to the invoice terms. Overdue balances may result in suspension of future services. The client agrees to pay applicable late fees, collection costs, court costs, and reasonable attorney’s fees incurred in collecting unpaid balances where permitted by law.
Neighboring Property Access
When work requires access to neighboring property, the client is responsible for obtaining permission from adjoining owners. GroundWorx Lawn Care will not access neighboring property without authorization.
Subsoil & Site Conditions
GroundWorx Lawn Care is not responsible for unforeseen site conditions including unsuitable soil, buried debris, tree roots, underground construction materials, utility conflicts, excessive groundwater, or concealed conditions that increase labor or material costs.
Photographs
GroundWorx Lawn Care may photograph the property before, during, and after services for documentation, quality control, marketing, insurance, or dispute-resolution purposes unless prohibited by law or agreed otherwise in writing.
Claims for Damage
Claims concerning alleged property damage or incomplete work must be reported in writing within forty-eight (48) hours after service. Failure to provide timely notice constitutes acceptance that work was completed satisfactorily, except where prohibited by law.
Limitation of Liability
To the fullest extent permitted by law, GroundWorx Lawn Care’s total liability for a claim arising from services will not exceed the amount paid for the specific service giving rise to the claim. GroundWorx Lawn Care is not liable for indirect, incidental, special, consequential, or punitive damages.
Acceptance
Approval of a quote, scheduling of services, or acceptance of work confirms that the client has read, understood, and agreed to these Terms & Conditions.
